ForIT Solutions® Office License Agreement

This License Agreement represents a legal agreement between you (as a natural or legal person, end user) and ForIT Solutions S.R.L. for the use of the software “ForIT Solutions® Office”, belonging to ForIT Solutions S.R.L., which includes the product itself and the services, and may include associated information media, printed materials, and online or electronic documentation (referred to hereinafter as “ForIT Solutions® Office”). All of these are protected by international copyright and intellectual property law, as well as by international treaties. By installing, using, copying or otherwise using the “ForIT Solutions® Office”, you accept the terms of this contract. If you do not agree to the terms of this contract, do not install or use the product “ForIT Solutions® Office”.

LICENSE “ForIT Solutions® Office”. “ForIT Solutions® Office” is protected by international copyright laws and treaties, as well as by other intellectual property laws and treaties. “ForIT Solutions® Office” is offered under license and not sold.

GRANTING OF LICENSE. ForIT Solutions S.R.L offers you, and only you, the following non-exclusive, limited, non-transferable license to use the “ForIT Solutions® Office” software application. The license can only be granted by ForIT Solutions S.R.L., may be distributed by ForIT Solutions S.R.L. and authorized partners of ForIT Solutions S.R.L.

LICENSE KEY AND LICENSE ACTIVATION. The license key is a character string consisting of numbers and letters separated by the ‘-‘ symbol. By activating the license key it is understood that the product will connect to the web site of ForIT Solutions S.R.L. (http://www.foritsolutions.com) and will send information about the physical characteristics of the network cards of the computer on which it is installed, in order to validate the license and increase the number of activations. ForIT Solutions S.R.L. states that by activating the license, personal data are NOT transmitted. It is mandatory to activate each license. Licenses can be activated online (requires Internet connection on the computer on which the license is installed) or offline (requires Internet connection on a computer other than the one on which the license is to be installed). The license key will be transmitted (if activated) to ForIT Solutions S.R.L. also when the user send error reports using the built-in error reporting system.

VALIDATION OF THE LICENSE. The procedure for validating the license consists in verifying the validity of the license key in the case of legal entities or natural persons. For legal entities, the license is associated with their unique identification code (tax identifier, fiscal code). If, upon validation of the license, it is found that the license is used by a company other than the one for which it was issued, the license will be automatically deactivated. The license validation procedure can be initiated automatically by the software application or by ForIT Solutions S.R.L.

DEMO LICENSE: “ForIT Solutions® Office” can be installed using a DEMO license key that is valid 30 days from the date of request, after which “ForIT Solutions® Office” will stop working or the product will be restricted. The DEMO license can be used for product evaluation and testing. The DEMO license can be applied for immediately after installation directly from the software application, upon its first launch.

SOFTWARE APPLICATION. You can install and use “ForIT Solutions® Office” on any computer that is required within the total number of activations included in the activation key. You can make only one additional copy as a backup.

DURATION OF THE LICENSE. The license granted here will begin on the date you install “ForIT Solutions® Office” and will continue until the end of the period for which the license was purchased or applied for.

EXPIRY. The product will cease to operate immediately after the license expires.

COPYRIGHT. All rights, titles and benefits relating to “ForIT Solutions® Office” (including, but not limited to any image, photo, animation, video, audio, music, text and code, incorporated into the “ForIT Solutions® Office” product), all printed materials accompanying the product and any copies of the product “ForIT Solutions® Office” are the property of ForIT Solutions S.R.L.. “ForIT Solutions® Office” is protected by international laws and treaties on copyright and intellectual property. Therefore, “ForIT Solutions® Office” should be treated as any other copyrighted material. You may not copy the printed materials accompanying “ForIT Solutions® Office”. You are required to submit and include all copyright notes in their original form in all copies created, regardless of the transmission medium or the form in which “ForIT Solutions® Office” exists. Sub-licensing, renting, leasing, selling, assigning or sharing the “ForIT Solutions® Office” license is prohibited. Also, hacking, recompiling, disassembling, creating derivative products, modifying, translating, or any other attempt to discover the source code of the “ForIT Solutions® Office” product is prohibited.

LIMITATION OF THE WARRANTY. ForIT Solutions S.R.L does not guarantee the continuous operation of the product, the absence of errors or the possibility of correcting them. ForIT Solutions S.R.L cannot guarantee that the product “ForIT Solutions® Office” will fully meet your requirements.

Except as expressly stated in this Agreement, ForIT Solutions S.R.L DISCLAIMS THE LIABILITY FOR ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE PRODUCTS, IMPROVEMENTS, MAINTENANCE OR SUPPORT RELATED TO THEM, OR ANY OTHER MATERIALS, OR SUCH MATERIALS OR OTHERWISE.

DECLARATION OF LIABILITY IN CASE OF DAMAGES. Any person who uses, tests or evaluates “ForIT Solutions® Office” assumes the risk related to its quality and performance. ForIT Solutions S.R.L. shall not be liable, in any case, for damages of any kind, including, without limitation, direct or indirect damages, resulting from the use, performance or delivery of “ForIT Solutions® Office”, even if ForIT Solutions S.R.L. was informed of the existence or possibility of their occurrence. SOME STATES PROHIBIT THE LIMITATION OR DECLARATION OF LIABILITY IN THE EVENT OF INDIRECT DAMAGES, SO THE ABOVE MENTIONED MAY NOT APPLY TO YOU. IN NO CASE, THE RESPONSIBILITY OF ForIT Solutions S.R.L. WILL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT “ForIT Solutions® Office”. The above disclaimers and disclaimers will apply regardless of whether you agree to use, evaluate or test “ForIT Solutions® Office”.

IMPORTANT NOTICE FOR USERS. THIS PRODUCT MAY INCLUDE ERRORS AND IS NOT DESIGNED OR INTENDED FOR USE IN A HIGH RISK ENVIRONMENT WHICH NEEDS PERFORMANCE OR OPERATION IN ABSOLUTE SECURITY CONDITIONS. THIS SOFTWARE IS NOT FOR USE IN THE OPERATION OF AIRCRAFT NAVIGATION, NUCLEAR FACILITIES, OR COMMUNICATION SYSTEMS, WEAPONS SYSTEMS, DIRECT OR INDIRECT LIFE-SUPPORT SYSTEMS, AIR TRAFFIC CONTROL, OR ANY APPLICATION OR INSTALLATION WHERE an error COULD RESULT IN DEATH OR SERIOUS INJURY OF SOME PEOPLE OR DAMAGE OF PROPERTY.

GENERAL. This agreement is subject to the laws of Romania and the international regulations and treaties on copyright and intellectual property. The exclusive jurisdiction and the location of the judgment of any dispute that may arise from these terms of license shall be that of the Romanian courts. The prices, costs and amounts of money for using “ForIT Solutions® Office” can be changed without prior notice. In the event of invalidity of any portion of this Agreement, such invalidity shall not affect the validity of the other portions of this Agreement. All registered trademarks used in the product or associated materials are the property of their rightful owners. The license will terminate immediately, without notice, if you violate any of its terms or conditions. Upon termination of the license you will not be entitled to the money back by ForIT Solutions S.R.L. or any of its distributors. The terms and conditions regarding confidentiality and restrictions of use will remain in force after any termination of the license.

ForIT Solutions S.R.L. may revise these terms at any time, and the revised terms will automatically apply to the appropriate product versions, distributed with the revised terms. If any part of these terms is found to be null and void, this will not affect the validity of the remaining terms, which will remain in effect.
